Drink drivers named and shamed in Devon

Every week the courts in Exeter deal with defendants accused of drink driving.

The legal limit for driving with alcohol in your system in England and Wales is 35 microgrammes of alcohol in 100 millilitres of breath.

You could be imprisoned, banned from driving and face a fine if you’re found guilty of drink driving.

The actual penalty you get is up to the magistrates who hear your case, and depends on your offence.

You may be able to reduce your ban by taking a drink-drive rehabilitation scheme (DDRS) course if you’re banned from driving for 12 months or more. It’s up to the court to offer this.

Here DevonLive takes a look at those who have appeared before the magistrates and been convicted for drink driving offences in the past fortnight.

JUNE 17

Alan Ring, Kerswell, Cullompton. Age: 49. On 31/05/21 on A373 at Cullompton. 144 microgrammes of alcohol in 100 millilitres of breath. Adjourned until 8/7/2021. Interim disqualification until dealt with.

Jad Ajou Barnes, Mount Binham Court, Exeter. Age: 22. On 17/05/2021 on Honiton Road. 87 microgrammes of alcohol in 100 millilitres of breath. Community order. Unpaid work for 50 hours. Disqualified from holding or obtaining a licence for 45 months.

Melody Gowe, Auckland Drive, Birmingham. Age: 45. On 05/06/2021 on A30 Exeter. 104 microgrammes of alcohol in 100 millilitres of breath. Adjourned to 15/07/21.

Francis Nicholas Lyons, Victoria Road, Exmouth. Age 50. On 31/01/2021 at Moorland Road, Exmouth. 82 microgrammes of alcohol in 100 millilitres of breath. Adjourned to 12/07/2021.

James Michael Rankin, Meneage Street, Helston, Cornwall. Age: 36. On 15/05/21 at A394 Penryn. 62 microgrammes of alcohol in 100 millilitres of breath. Fined £450. Disqualified from holding or obtaining a licence for 17 months.

JUNE 18

Andrew Lee James, Lagoon View, West Yelland, Barnstaple. Age: 27. On 22/05/2021 at Bideford on B3233 between bideford and instow, drove whilst unfit to drive through drink. Fined £438. To pay a surcharge to fund victim services of £44. To pay costs of £85 to the Crown Prosecution Service.

JUNE 21

Katarzyna Magdelena Machaj, Zeal Monachorum Crediton. Age: 30. On 14/05/2021 at A377 Bugford Cross Crediton. 57 microgrammes of alcohol in 100 millilitres of breath. Remanded on bail until 14/07/2021.

Peregrine St John Watson, Goonlaze Farm, St Agnes, Cornwall. Age: 58 On 23/08/2020 on Sidmouth Road, Exeter. 46 microgrammes of alcohol in 100 millilitres of breath. Fined £120. To pay a surcharge to fund victim services of £34. To pay costs of £85 to the Crown Prosecution Service. Disqualified from holding or obtaining a driving licence for 12 months.

Drink drive punishments in England

You may get:

  • 3 months’ imprisonment
  • up to £2,500 fine
  • a possible driving ban

You may get:

  • 6 months’ imprisonment
  • an unlimited fine
  • a driving ban for at least 1 year (3 years if convicted twice in 10 years)

Refusing to provide a specimen of breath, blood or urine for analysis

You may get:

  • 6 months’ imprisonment
  • an unlimited fine
  • a ban from driving for at least 1 year

Causing death by careless driving when under the influence of drink

You may get:

  • 14 years’ imprisonment
  • an unlimited fine
  • a ban from driving for at least 2 years
  • an extended driving test before your licence is returned

You won’t automatically get your licence back if you’re a high risk offender.

Other problems you could face

A conviction for drink-driving also means:

  • your car insurance costs will increase significantly
  • if you drive for work, your employer will see your conviction on your licence
  • you may have trouble travelling to countries like the USA

Amy Jane Heywood, Taw Wharf, Barnstaple. Age: 29. On 09/06/2021 at Torrington drove a motor vehicle, namely Audi TT, on a road, namely A388, Hele Lane, Frithelstock. 49 microgrammes of alcohol in 100 millilitres of breath. Fined £415. To pay a surcharge to fund victim services of £42.To pay costs of £85 to the Crown Prosecution Service. Disqualified from holding or obtaining a driving licence for 14 months.

Steven Lee Mckellar, Beach Road, Mortehoe, Woolacombe. Age: 33. On 28/05/2021 at Woolacombe on the B3433. 77 microgrammes of alcohol in 100 millilitres of breath. Community order made. Alcohol Abstinence Requirement: Abstain from consuming any alcohol throughout a period of 90 days. Carry out unpaid work for 40 hours. To pay a surcharge to fund victim services of £95. To pay costs of £85 to the Crown Prosecution Service. Disqualified for holding or obtaining a driving licence for 40 months.
